Alabama Senate Committee Advances Bill to Expand Public Smoking Ban to E-Cigarettes

 

A bill in the U.S. state of Alabama, Senate Bill 9 (SB9), has been approved by the Senate Healthcare Committee and seeks to update the state’s Clean Indoor Air Act by extending existing indoor public smoking bans to include e-cigarettes and other vapor products.

According to WDNews, a bill that would prohibit the use of e-cigarettes in most enclosed public places in Alabama has been approved by the Senate Healthcare Committee and will be submitted to the full Senate for consideration.

SB9 proposes to update Alabama’s Clean Indoor Air Act by placing e-cigarettes and other vaporizing devices under the same restrictions that apply to traditional smoking. The bill was introduced by Republican State Senator Gerald Allen of Cottondale, who seeks to include the “use of electronic nicotine delivery systems” within the statutory definition of “smoking.”

The current Clean Indoor Air Act, enacted in 2003, prohibits smoking in most enclosed public places, including restaurants, retail establishments, government buildings, hospitals, nursing homes, shopping malls, elevators, airports, and banks. Violations of the law are subject to a $25 fine.

Senator Allen stated that he reintroduced the bill after observing e-cigarette use at football-related venues, including a high school stadium and Bryant-Denny Stadium. He had proposed similar legislation during the 2025 legislative session, but it did not pass.

In addition to expanding the scope of the restrictions, SB9 would rename the law the “Vivian Davis Figures Clean Indoor Air Act” in honor of Vivian Davis Figures, who was instrumental in advancing the original smoking ban legislation.
